Terms and Conditions
The flat fee includes all mediation sessions included in the particular package purchased, preparation of settlement agreements, and reasonable email and phone communication related to the mediation process. The flat fee does not include court filing fees or services outside the scope of the mediation process. Payment is due in full prior to the commencement of services. The inclusion of this rate schedule on the Forester Family Law website does not, by itself, create a mediator-client relationship. Such a relationship is established only after a written agreement for mediation services is signed by all parties and the mediator, and the attendant fee has been paid. All parties agree to uphold the confidentiality of the mediation process as required by law.
The Flat Fee Mediation Process
Flat Fee Mediation offers a streamlined, predictable, and cost-effective approach to resolving financial agreements during divorce, giving you peace of mind from start to finish.
- Decide on Flat Fee Mediation: Opt for a more efficient and transparent process to handle your financial agreement.
- Upfront Payment: Pay half of the total fee after the first session. The remaining half is due upon presentation and is held in a trust account until the work is complete.
- Flexible Mediation Pace: Work through the mediation at your own pace, guided by the chosen package.
- Completion and Judgment Filing: Finalize the agreement and file the judgment with the court, avoiding surprise charges and ensuring the process stays within the agreed fee.

What Does The Flat Fee Cover?
The flat fee covers all aspects of the mediation process except for the court’s filing fee. Specifically, it includes:

Initial Agenda Setting Meeting: All necessary planning and organization to start the mediation process.

Substantive Hours of Mediation: Comprehensive mediation sessions aimed at resolving disputes.

Communication: All communication between the mediator and clients throughout the mediation process.

Drafting and Re-Drafting of Agreements: Creation, review, and revisions of any necessary agreements.

Court Filings: Any interactions and documentation with the court to ensure all papers are properly filed.
How Is The Flat Fee Determined?
The flat fee is determined through a discussion with the clients. The complexity and number of issues to be resolved will influence the amount of time required, and thus, the fee.
The levels of flat fee packages are based on the hours spent in the mediation room.
Are There Any Hidden Costs?
There are only two potential additional costs:

Filing Fee: If the petition has not yet been filed, there is a $435 fee for filing it with the court. Some clients may already have their petitions filed, so this fee would not apply.

Additional Mediation Sessions: If clients require additional mediation sessions, those costs are covered in the next point.
What If Additional Mediation Sessions Are Needed?
Yes, additional mediation time can be purchased in two-hour blocks. The cost structure is as follows:

First Session: $850 for the initial two-hour block.

Second Session: $1150 for the next two-hour block.
For example, if you are on the Silver Package, which costs $5800, and you require an additional four hours of mediation time:

The cost of the second two-hour block will equate to the amount it would have cost to upgrade to the Gold Package.
